    Rosenshyne can be excused for her glaring error due to a recent pregnancy. But on the subject, the point is that people should be careful and situationaly aware. If something is hot you should know it, because you check and test. It's not that hard. But the main thing is, the coffee spill was an ACCIDENT. In other words, non-intentional. McDonalds did not set out to burn people with the coffee. So whether they make their coffee too hot or not is irrelevant. If the woman didn't spill the coffee on herself, she wouldn't have been burned. Therefore, it was her fault, not McDonalds'.

    Thats not what the courts decided.

    McDonald's served coffee at a temperature which, when spilled on your crotch, is proven to inflict third degree burns to your vagina. There was no warning about how hot it was. The fact that neither party intended for the coffee to be spilled is recognized, but irrelevant, because McDonald's never made it clear that the coffee was so hot it could harm you. It may have been her fault that she spilled it, but it was McDonald's fault that she was served coffee that was hot enough to give her third degree burns.

    Thats my whole argument.

    I think we obviously see this two different ways though. You see a woman stupid enough to spill coffee on herself, and I see a restaurant stupid enough to serve coffee hot enough to burn its customers.

    And I think both of you are right. It's both's fault, let McDonalds pay her 1 million, and then let her pay herself one million and everyone will be happy :).

    Recently, a high-school girl was awarded 1.5 million for punitive damages suffered from advice from her track coach. The coach advised her to "lose ten pounds," and she duly got an "eating disorder." Need I say more?

    That's fucking ridiculous. And people complain about skyrocketing insurance costs. It's because of these fucking pansies who decide they need millions of dollars for twisting an ankle or somesuch. Legal systems have become a joke these days. Anyone who files a frivilous lawsuit or who asks for a ridiculous amount of money (when compared to the event in question) needs to be shot.

    Ugh, the lawsuits aren't so frivolous as the rewards. If that girl got 1,000 dollars, I'd be annoyed, but I wouldn't complain. Who the fuck is going to pay 1 and a half million dollars on a teachers sallary?

    Such as, the black guy who sued because of "Master and Slave" and they had to change it to "Primary and Secondary." What is this fucking world coming to?

    My dad said the same thing yesterday when we were discussing the topic on the way back home from sweet New Jersey. Not in so many words, though. And Sleek, my "need I say more" remark wasn't supposed to indicate that I was making a point about McDonalds, I was just implying that no comment needed to be made, because the case was so obviously a travesty.

    damn, i should have sued my track coach cuz i tore the cartilege in my knee, and he told me to keep running on it, and i tore a tendon and i can never run again... i hate missing the boat on these sort of things...

    it's not bad enough of an injury that insurance will cover it, but just bad enough that i have limited motion. basically, the tendon healed, but with a whole mess of scar tissue, which is what's causing the problem.

    well, technically, i can jog about 50 feet. then i have to put my leg up and ice my knee for an hour... so, yeah, i don't run. i'm sure if some psycho with a knife chased me, i'd run, but otherwise, i just walk.

    What I think is better than all of this, is that a girl can claim sexual assault on a guy without an evidence, and win, where as a guy who tries the same, will be questioned to the ends of his wits, and forced to give evidence.

    That is the biggest bullshit I have ever heard, Matt. Do you know what women who accuse men of rape are put through? Not only have they been raped (if they have), which is horrible, but then they are usually dragged through the mud in the trial. They are asked by the defense lawyers how short their skirts were and are called sluts and whores and told that they deserved it.

    As far as I know, it's pratically impossible for a man to be raped by a women, not only because of logistics but also because of size and strength. The only time I've heard of a man being "raped" by a woman was when that man killed a girl in Central Park and claimed she tried to rape him.
