My point is; she said her pc cant handle the unpatched version, meaning she is patched, otherwise she couldnt play at all, so why would you assume she isnt patched?

He didn't say he was patched; he said that his computer could not handle the unpatched version. As he then went on to describe things that were fixed with the patch, it seemed to me that he was playing unpatched, however badly. Either that, or his computer can't handle the patch as well as not handling not having the patch, or he's not playing Arcanum at all.

You can make Virgil learn Necromatic Black magic by having leave your party (dont kill any guards) after you are done with the dark elves. You'll find him later. Revive him and you're done.
